These Terms and Conditions (“Terms“) constitute a legally binding agreement between you (“Customer,” “you,” or “your“) and Dilara Collection Ltd (“Dilara Collection,” “we,” “us,” or “our“), a company registered in the Republic of Rwanda, operating as the exclusive authorized dealer and representative of Kelebek Mobilya Sanayi ve Ticaret A.Ş. (“Kelebek Furniture”) in Rwanda.

By accessing our website at dilaracollection.com, creating an account, placing an order, or making a purchase through our website or showroom, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

These Terms are governed by and construed in accordance with the laws of the Republic of Rwanda, including but not limited to Law N° 36/2012 of 21/09/2012 Relating to Competition and Consumer Protection, and Law N° 007/2021 of 05/02/2021 Governing Electronic Transactions and Electronic Signatures.

1. Definitions

  • “Agreement” means these Terms and Conditions, together with our Privacy Policy, Cookie Policy, and any order confirmation issued by us.
  • “Business Day” means any day other than Saturday, Sunday, or public holidays in Rwanda.
  • “Goods” or “Products” means the furniture, home accessories, and related items offered for sale by Dilara Collection.
  • “Order” means a request by you to purchase Goods from us, whether placed online through our website or in person at our showroom.
  • “Order Confirmation” means the email or written acknowledgment sent by us confirming receipt of your Order.
  • “RWF” means Rwandan Franc, the official currency of the Republic of Rwanda.
  • “Website” means dilaracollection.com and all associated subdomains.

2. Eligibility

  • You must be at least 18 years of age or the age of legal majority in your jurisdiction to place an order.
  • By placing an order, you represent and warrant that you have the legal capacity to enter into a binding contract.
  • If you are placing an order on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

3. Products and Product Information

  • We make every reasonable effort to ensure that product descriptions, images, dimensions, colors, and specifications on our website are accurate. However, slight variations may occur due to manufacturing processes, screen display differences, and material characteristics inherent to furniture production.
  • Product images are for illustrative purposes. Actual products may differ slightly in color, texture, grain pattern, or finish from photographs displayed on the website.
  • Furniture dimensions listed are approximate and may vary by ±2cm due to manufacturing tolerances.
  • Product availability is subject to stock levels and may change without prior notice. We will notify you promptly if a product becomes unavailable after you place an order.
  • We reserve the right to modify product specifications, discontinue products, or update our catalog at any time.

4. Ordering Process

4.1 Online Orders

  1. Browse our product catalog and add desired items to your shopping cart.
  2. Review your cart contents, quantities, and selections.
  3. Proceed to checkout and enter your billing and shipping information.
  4. Select your preferred payment method.
  5. Review your complete order summary, including pricing and delivery details.
  6. Submit your order by clicking “Place Order.”

4.2 Order Acceptance

Submission of an order constitutes an offer to purchase. An Order Confirmation email acknowledges receipt of your order but does not constitute acceptance. Your order is formally accepted by us only when we: (a) confirm product availability; (b) verify payment receipt; and (c) dispatch the goods or confirm a delivery date in writing.

4.3 Order Cancellation by Us

We reserve the right to cancel or refuse any order for any lawful reason, including but not limited to: pricing errors, product unavailability, suspected fraud, or inability to verify payment. In such cases, we will notify you promptly and issue a full refund.

5. Pricing and Payment

5.1 Pricing

  • All prices on our website are displayed in Rwandan Francs (RWF).
  • Prices include Value Added Tax (VAT) at the applicable rate as determined by Rwanda Revenue Authority, unless explicitly stated otherwise.
  • Delivery charges, if applicable, are calculated separately and displayed at checkout before order submission.
  • We reserve the right to change prices at any time. Price changes do not affect orders that have already been confirmed and paid for.
  • In the event of a manifest pricing error (e.g., a product listed at RWF 0 or at a price clearly inconsistent with the product’s value), we reserve the right to cancel the order, notify you, and offer to sell the product at the correct price.

5.2 Payment Methods

We accept the following payment methods:

  • MTN Mobile Money: Payments processed through MTN Rwanda’s secure mobile payment platform.
  • Airtel Money: Payments processed through Airtel Rwanda’s mobile payment system.
  • Bank Transfer: Direct bank deposit or wire transfer to our designated business account. Orders are processed upon confirmation of funds receipt.
  • In-Store Payment: Cash, Mobile Money, or card payments at our Kigali showroom.

5.3 Payment Terms

  • Full payment is required before delivery, unless a custom payment arrangement is agreed in writing.
  • For custom or imported orders, we may require a non-refundable deposit of up to 50% of the order value at the time of order placement, with the balance due before delivery.
  • We issue receipts and invoices for all transactions in compliance with RRA requirements.

6. Delivery

6.1 Delivery Zones and Fees

  • Kigali City: Free delivery for orders above RWF 500,000. Standard delivery fee applies for orders below this threshold.
  • Rwanda (Outside Kigali): Delivery is available nationwide. Fees are calculated based on distance, order size, and accessibility, and are communicated at checkout or upon request.
  • International: We do not currently offer international shipping. Customers outside Rwanda may arrange their own collection and transport from our Kigali showroom.

6.2 Delivery Timeline

  • In-stock items: 3–7 Business Days within Kigali; 5–14 Business Days outside Kigali.
  • Custom or imported orders: 4–12 weeks, depending on product type and origin.
  • Delivery dates provided are estimates only and do not constitute guaranteed delivery dates. We will make reasonable efforts to meet estimated timelines and will notify you of any significant delays.

6.3 Delivery and Risk Transfer

  • Risk of loss or damage to the goods passes to you upon delivery to your specified address.
  • You or your authorized representative must be present to receive delivery and inspect the goods.
  • You must inspect all goods upon delivery and note any visible damage or defects on the delivery receipt before signing.
  • Claims for damage discovered after delivery must be reported within 48 hours with supporting photographs.

6.4 Assembly Services

  • We provide free assembly for all furniture delivered within Kigali.
  • Assembly for deliveries outside Kigali may be available at additional cost.
  • Assembly is performed by our trained technicians and includes placement in your room of choice (ground floor access; stairs or elevator access may incur additional charges).

7. Returns and Exchanges

Your rights as a consumer are protected under Law N° 36/2012 Relating to Competition and Consumer Protection. In addition, we offer the following return and exchange policy:

7.1 Standard Returns

  • You may return eligible products within 14 calendar days of delivery for a full refund or exchange.
  • Products must be unused, unassembled (or re-disassembled by our technicians), and returned in their original packaging and condition.
  • To initiate a return, contact us at hi@dilaracollection.com with your order number, product details, and reason for return.

7.2 Defective or Incorrect Products

  • If you receive a defective, damaged, or incorrect product, you are entitled to a full refund or free replacement, including return shipping at our expense.
  • Report defects within 48 hours of delivery with photographs of the defect and packaging.
  • We will arrange collection of defective products at no cost to you.

7.3 Non-Returnable Items

  • Custom-made, bespoke, or made-to-order furniture
  • Products assembled by the customer (as opposed to our assembly team)
  • Products with signs of use, stains, scratches, or damage not attributable to us
  • Products returned without original packaging
  • Clearance or final-sale items (clearly marked as non-returnable at time of purchase)

7.4 Refund Process

  • Approved refunds are processed within 14 Business Days of our receipt and inspection of the returned product.
  • Refunds are issued using the original payment method (MTN Mobile Money, Airtel Money, or bank transfer).
  • For returns that are not due to our error, the customer bears the return shipping cost, which may be deducted from the refund amount.

8. Warranty

8.1 Manufacturer Warranty

  • All Kelebek furniture products carry a manufacturer warranty provided by Kelebek Mobilya, covering defects in materials and workmanship under normal domestic use.
  • Warranty periods vary by product category and are specified in the product documentation included with your purchase.
  • The warranty covers: structural defects, manufacturing flaws, premature failure of mechanisms (drawers, hinges, slides), and material defects.

8.2 Warranty Exclusions

The warranty does not cover:

  • Damage resulting from misuse, negligence, accidents, or improper maintenance
  • Normal wear and tear (including fabric fading, minor scratches, or surface patina)
  • Damage from unauthorized modifications, repairs, or assembly
  • Damage caused by exposure to extreme conditions (excessive moisture, direct sunlight, heat)
  • Commercial use of products designed for domestic use
  • Variations in natural materials (wood grain, leather texture, stone patterns)

8.3 Warranty Claims

To make a warranty claim, contact us at hi@dilaracollection.com with: (a) proof of purchase; (b) detailed description of the defect; (c) photographs clearly showing the issue. We will assess the claim and respond within 14 Business Days.

9. Intellectual Property

  • All content on this website — including text, images, photographs, graphics, logos, icons, videos, software, and design elements — is the property of Dilara Collection Ltd, Kelebek Mobilya Sanayi ve Ticaret A.Ş., or their respective licensors, and is protected by Rwandan and international intellectual property laws.
  • The Kelebek, Dilara Collection, and related logos and trade names are registered trademarks. Unauthorized use constitutes trademark infringement.
  • You may not reproduce, distribute, modify, create derivative works from, publicly display, transmit, or otherwise exploit any content from this website without our prior written consent.
  • Limited personal, non-commercial use (e.g., printing a product page for personal reference) is permitted.

10. User Obligations

By using our website and services, you agree to:

  • Provide accurate, current, and complete information when creating an account or placing an order
  • Maintain the confidentiality of your account credentials and accept responsibility for all activities under your account
  • Use the website only for lawful purposes and in compliance with these Terms
  • Not attempt to gain unauthorized access to our systems, interfere with website functionality, or introduce malicious code
  • Not use automated tools (bots, scrapers) to access or extract data from our website without written permission
  • Notify us immediately of any unauthorized use of your account

11. Account Termination

  • You may close your account at any time by contacting us at hi@dilaracollection.com.
  • We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if your account shows prolonged inactivity (24+ months).
  • Account termination does not affect any outstanding orders, warranties, or your legal rights under Rwandan consumer protection law.
  • Upon termination, your personal data will be handled in accordance with our Privacy Policy.

12. Limitation of Liability

  • To the maximum extent permitted by Rwandan law, Dilara Collection Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to: your use of our website; purchase of our products; inability to use our services; or any errors, interruptions, or delays in our website.
  • Our total aggregate liability for any claim arising under these Terms shall not exceed the purchase price of the specific product(s) giving rise to the claim.
  • Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded by Rwandan law.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics or epidemics, war or civil unrest, government actions or sanctions, customs or import delays, shipping disruptions, supplier failures, power outages, telecommunications failures, or strikes. In the event of force majeure, we will notify you as soon as practicable and make reasonable efforts to mitigate the impact.

14. Dispute Resolution

14.1 Amicable Resolution

In the event of any dispute arising from or relating to these Terms or any transaction with us, we encourage you to first contact us at hi@dilaracollection.com. We commit to engaging in good-faith negotiation for a period of 30 days to attempt an amicable resolution.

14.2 Arbitration

If the dispute cannot be resolved amicably within 30 days, either party may refer the dispute to arbitration administered by the Kigali International Arbitration Centre (KIAC), in accordance with its arbitration rules then in effect. The arbitration shall be conducted in English, in Kigali, Rwanda.

14.3 Litigation

As a last resort, disputes may be submitted to the competent courts of Kigali, Rwanda. These Terms are governed exclusively by the laws of the Republic of Rwanda.

14.4 Consumer Protection

Nothing in this dispute resolution clause limits your rights under Law N° 36/2012. You may at any time file a complaint with the Rwanda Inspectorate, Competition and Consumer Protection Authority (RICA).

15. Amendments

We reserve the right to amend these Terms at any time. For material changes, we will provide 30 days’ advance notice via email to registered users or by posting a prominent notice on our website. Your continued use of our website or services after the effective date of any changes constitutes your acceptance of the amended Terms. If you do not agree with the amended Terms, you must stop using our website and services.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any order confirmation, constitute the entire agreement between you and Dilara Collection Ltd regarding the subject matter hereof. They supersede all prior agreements, understandings, and communications, whether written or oral.

These Terms and Conditions are effective as of March 1, 2026 and shall remain in effect until amended or replaced in accordance with Section 15 above.
